Both but only one

On page 412 of Riano's Criminal Procedure, Updated Edition, 2011 we read this:


Question: who is the other party which make up the "both" with the District Court? At first glance, it seems the sentence should be "Both the IRS and the District Court ordered . . . ".

But that is not how it appeared in the decision as shown in the following portion:

Civil action to criminal action vice versa

From page 368 of Remedial Law and Compendium, Vol. II, 11th Ed.  by Regalado:


Notice that Rule 111, Sec. 5 talks of final judgment in a civil action not being a bar to a criminal action.

In the Note, however, Regalado gave the inverse example -  a finished criminal action not being a bar to a civil action.

Who controls the buyer?

In the Civil Code of the Philippines, Annotated, Vol. V, 2013 Ed., in relation to Article 1498, Paras talks of the requirements before ownership can be transferred by way of constructive delivery.

First, on page 114, the seller must have control.


OK, got that. But on the next page he said:


So, who is in control of the buyer? See this portion from Addison v. Felix.
